Terms of Service

01. Acceptance and Binding Agreement
These Terms of Service ("Terms") constitute a legally binding agreement between Paradigm Confab ("Company", "we", "us", or "our") and the subscribing legal entity ("Subscriber", "Firm", or "you") governing the access and utilization of the myPeshkar digital legal workspace ("Platform").
By executing a registration, verifying an identity token (OTP), or accessing the Platform, the Subscriber acknowledges that they have read, understood, and unequivocally agree to be bound by these Terms. If the individual accepting these Terms is acting on behalf of a corporate entity or law firm, such individual warrants they possess the requisite legal authority to bind said entity.
02. Nature of the Service
The Platform is a proprietary, multi-tenant Software-as-a-Service (SaaS) operational architecture designed to facilitate litigation docket management, secure evidentiary storage, and intra-firm collaboration.
Disclaimer of Legal Advice: The Company is an enterprise software provider. The Platform, its automated notifications, and its organizational frameworks do not constitute, nor shall they be construed as, legal advice, legal representation, or a substitute for professional legal judgment.
03. Account Provisioning and Security
The Subscriber is granted a non-exclusive, non-transferable, revocable license to utilize the Platform solely for internal business operations. The Subscriber bears absolute responsibility for:

Access Control (RBAC) Governing and auditing the authorization levels (e.g., Lawyer Admin, Member, Intern) granted to its end-users.

Credential Integrity Safeguarding all cryptographic keys, passwords, and multi-factor authentication vectors associated with the Firm's tenant workspace.
The Company bears no liability for data breaches, unauthorized access, or internal malfeasance resulting from the Subscriber's failure to secure their credential infrastructure.
04. Acceptable Use and Restrictions
The Subscriber covenants and warrants that they shall not, nor permit any authorized user or third party to:
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Platform.
- Circumvent, disable, or interfere with any security protocols or encrypted vault mechanisms within the Platform.
- Upload malicious code, viruses, or any payload designed to compromise the systemic integrity of the Platform.
- Upload client or third-party data ("Tenant Data") for which the Subscriber does not possess the requisite lawful basis, consent, or statutory authority.
05. Intellectual Property and Data Ownership
Platform IP: Paradigm Confab retains all right, title, and interest (including all patent, copyright, trademark, and trade secret rights) in and to the Platform, its underlying algorithms, the user interface, and all derivative works thereof.
Tenant Data: The Subscriber retains absolute ownership of all Tenant Data (client records, case files, docket entries) uploaded to the Platform. The Company claims no intellectual property rights over Subscriber-owned data and processes it solely in the capacity of a Data Processor.
06. Warranties and Limitation of Liability
"AS IS" Basis: The Platform is provided on an "as is" and "as available" basis. While the Company employs enterprise-grade infrastructure to maximize uptime, we expressly disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Liability: To the maximum extent permitted by applicable law, in no event shall the Company be liable for any indirect, incidental, consequential, special, or punitive damages (including loss of profits, data, or operational continuity) arising out of or related to the use of the Platform, even if advised of the possibility of such damages.
07. Suspension and Termination
The Company reserves the right to immediately suspend or terminate a Subscriber's access to the Platform without prior notice in the event of:
- Failure to remit subscription fees within the prescribed billing cycle.
- A material breach of the Acceptable Use restrictions outlined in Section 04.
- A directive from a competent judicial or regulatory authority.
Upon termination for any reason, the Subscriber shall be granted a limited window to extract their Tenant Data, following which all encrypted data will be subjected to a permanent cryptographic purge.
08. Governing Law and Jurisdiction
These Terms, and any disputes arising out of or in connection with them, shall be governed exclusively by and construed in accordance with the laws of India. The parties irrevocably submit to the exclusive jurisdiction of the competent courts located in Kolkata, West Bengal, India.
